Terms and Conditions

These terms and conditions govern the provision of services by Emma Setterfield trading as Virtual M. By engaging our services, you agree to be bound by these terms. A signed service agreement will be provided prior to commencement of any work.

Confidentiality

We will keep confidential all information disclosed by you or your representatives in relation to the services we provide. You shall keep in strict confidence all know-how, processes or initiatives of a confidential nature concerning our business. A full non-disclosure agreement will be provided and signed by both parties prior to commencement of work.

Data Protection

We adhere to all applicable data protection laws. Our ICO registration number is ZA497289. Full details of how we handle your personal data are set out in our Privacy Notice.

Charges and Invoicing

Our services are charged at an hourly rate, agreed in writing before work commences. Invoices are issued monthly in arrears and are due within 7 days of issue. Service packages are available and will be set out in a separate written agreement. Weekend and bank holiday working may be available on request and will be subject to an additional charge. Urgent work may also incur an additional charge and is subject to availability.

Submitted Work and Communication

Work will be acknowledged within 24 hours of receipt during office hours, Monday to Friday. No work will commence until a signed service agreement is in place, full details of the work required have been confirmed, and all relevant access credentials have been provided.

Intellectual Property

All intellectual property in work produced by Virtual M on your behalf remains your property upon full payment of all invoices. We retain the right to reference the working relationship for portfolio and marketing purposes unless otherwise agreed in writing.

Limitation of Liability

Our liability to you in connection with any services provided shall not exceed the total fees paid by you in the three months preceding the event giving rise to the claim. We shall not be liable for any indirect, consequential, or special loss.

Testimonials

By submitting a testimonial via our website, email, or any other means, you agree that we may publish it, along with your name, on our website and social media channels. We may edit testimonials for length or clarity but will never alter them in a way that creates a misleading impression of your views. You may withdraw this permission by giving 7 days written notice to emma@virtualm.co.uk.

Governing Law

These terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the English courts.
